Leave Protections for Pregnant Workers in California

One of the areas where California law really stands out is in the leave protections available to pregnant employees. Multiple laws work together to ensure that pregnancy doesn’t force you to choose between your job and your health.

The Pregnancy Disability Leave law (PDL) provides up to four months of job-protected leave for employees who are “disabled by pregnancy, childbirth, or a related condition.” Unlike the federal FMLA, the PDL has no minimum tenure requirement. You’re eligible from your first day on the job as long as your employer has five or more workers.

After your pregnancy-related disability ends, the California Family Rights Act (CFRA) kicks in with up to 12 additional weeks of leave for bonding with your new child. The CFRA requires 12 months of employment and at least 1,250 hours worked in the preceding year to qualify. Taken together, the PDL and the CFRA can provide several months of protected time away from work.
